Realstagram ("we", "us" or "our") offers an AI-powered platform that features various user tools, including AI-powered tools to help users create images and videos. This Privacy Policy describes how Realstagram processes personal information that we collect through our digital properties that link to this Privacy Policy, including our website (realstagram.ai) and social media pages (collectively, the "Service"), as well as our marketing activities and other activities described in this Privacy Policy.

1. Personal information we collect

  • Profile data, such as the username and password that you may set to establish an online account on the Service, profile picture (if provided via OAuth), and any other information that you add to your account profile.

  • Payment data needed to complete transactions. Please note that payment data is collected and stored by our payment processor (Stripe) and not by Realstagram directly. We receive from Stripe your customer ID, subscription status, and billing period information.
  • User-generated content, such as text prompts, images, and videos that you upload to and process through the Service, as well as associated metadata.
  • Feedback data, such as information regarding your experiences with the Service.

1.2. Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:

  • Third-party services, such as Google, that you use to log into or otherwise link to your Service account. This data may include your username, profile picture and other information associated with your account on that third-party service.

1.3. Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, such as:

  • Device data, such as your computer or mobile device's operating system type and version, browser type, IP address, and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, and navigation paths between pages or screens.

2. How We Use Your Personal Information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

2.1. Service delivery and operations. We may use your personal information to:

  • provide, maintain, and improve the Service;
  • enable security features of the Service;
  • establish and maintain your user profile on the Service;
  • process your transactions and manage subscriptions;
  • communicate with you about the Service, including service-related announcements, updates, and support messages;
  • respond to your requests, questions and feedback.

2.2. Service improvement. We may use your personal information to analyze your usage of the Service, improve the Service, and develop new products and services.

2.3. Compliance and protection. We may use your personal information to:

  • protect our, your or others' rights, privacy, safety or property;
  • enforce the terms and conditions that govern the Service;
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity.

3. Retention

We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

  • Account data: Retained until you delete your account
  • Generated images: Subject to automatic expiration based on your subscription tier
  • Payment records: Retained for 7 years as required by tax and accounting laws

When we no longer require the personal information we have collected about you, we may either delete it, anonymize or aggregate it, or isolate it from further processing.

4. How We Share Your Personal Information

We may share your personal information with the following categories of parties and as otherwise described in this Privacy Policy:

  • Service providers. Third parties that provide services on our behalf or help us operate the Service, including hosting, customer support, and payment processing.
  • Payment processors. Stripe processes all payments and stores payment information. Stripe may use your payment data in accordance with its privacy policy, available at stripe.com/privacy.
  • AI model providers. We use third-party AI services (including RunPod and WaveSpeed) to generate images. Your prompts are sent to these services for processing.
  • Cloud storage. AWS S3 stores generated images.
  • Database and authentication. Supabase stores your account data and handles authentication.
  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for compliance and protection purposes.
  • Business transferees. We may disclose personal information in the context of actual or prospective business transactions (e.g., sale, transfer or merger of all or part of our business or assets).

5. Your Choices

5.1. Access or update your information. If you have registered for an account with us through the Service, you may review and update certain account information by logging into the account.

5.2. Opt-out of communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that you may continue to receive service-related and other non-marketing emails.

5.3. Cookies. We use only essential cookies that are strictly necessary for the operation of our Service (authentication and security cookies). We do not use any tracking, analytics, or advertising cookies.

5.4. Delete your account. If you wish to delete your account, please contact us at realstagram.business@gmail.com. Upon account deletion, we will delete or anonymize your personal data within 30 days, except where retention is required by law.

6. Other Sites and Services

The Service may contain links to websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.

7. Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect, including encryption of data in transit (TLS/HTTPS), encryption of data at rest, and access controls and authentication. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

8. International Data Transfers

We are based in Slovenia, a member state of the European Union. Your personal information may be transferred to and processed in countries outside the European Economic Area (EEA), including the United States, where some of our service providers are located. When we transfer data outside the EEA, we ensure appropriate safeguards are in place, including EU Standard Contractual Clauses (SCCs) and EU-US Data Privacy Framework certification where applicable.

9. Children

The Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us at realstagram.business@gmail.com. If we learn that we have collected personal information through the Service from a child without the consent of the child's parent or guardian where required by law, we will comply with applicable legal requirements to delete the information.

10. Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version. Your use of the Service after the effective date of any modified Privacy Policy indicates your acknowledging and agreeing that the modified Privacy Policy applies to your interactions with the Service.

11.1. Where this Notice applies. The information provided in this Notice to European Users section applies only to individuals located in the European Economic Area (EEA) or United Kingdom (UK).
